Valid and Invalid Reasons for a Dispute

A mention of the artist is often part of a license, but does not count as such. However, you still need permission from the copyright holder even if you mention them.

SoundCloud sees many grounds as the basis for disputes, although many of those grounds are legally invalid. Listed below are some of the reasons for filing a dispute along with an explanation of why it is valid or not. Please note that any dispute based on an invalid reason as listed below will be rejected by SoundCloud.


I bought the track online and / or have the CD or record

 

With the purchase of music, digital or physical, you do not get the right to share this track on SoundCloud. Online distribution is the right that belongs to the copyright owner and is not automatically transferred with your digital or physical purchase.

I only used a small portion of the copyrighted work

In general, if you use someone's work that is protected by copyright, you need their permission to post that work online on SoundCloud, whether in whole or in part (e.g. a sample).

I used someone's work but created something new

Did you have all rights from the author to use his work? If not, we cannot accept your objection.

I don't make any money with it

Still, you still need the owner's copyright rights even if you don't make money off of it.

Other tracks on SoundCloud contain the same copyrighted content

Permission to use or publish copyrighted material is granted on an individual basis by the copyright holder. The fact that someone else also has the rights to the same content does not mean that it is freely available to everyone. A separate license must be available in each case.

I received this as a free download and would like to share it

Some artists provide their album as a free download. In general, this only gives you the right to download and listen to it. That doesn't mean you can put it online on SoundCloud. You still need the permission of the copyright owner, even if they offer this track for free elsewhere.

 

I mention the artist

I'm a big fan of the artist and I want everyone to hear their music



That's great, but did the copyright holder give you OK for putting their music online on SoundCloud? Most artists want control over where their content appears, and if you don't have permission from all of the copyright owners, your dispute will be denied.



I believe my use is fair, so it has to be fair



Fair Use in the US is similar to the concept of anywhere else, it allows limited use of the copyrighted work under certain circumstances, for example for private study and reporting. Fair use is a complicated thing - there are many factors to consider, including the amount of copyrighted work that is used, how it is used, and the effect it has on the original copyrighted work. Each situation has to be considered individually. Even so (for example) it is highly unlikely that you will release a track from a DJ mix or mashup, mixed track or track because you think it is a good advertisement for the artist.
